HOLZER Y COMPAÑIA S.A. DE C.V., hereinafter the "Company" with trade name and trademark Nivada Swiss, through its Internet page called www.nivadaswiss.com (hereinafter the "Site"), will sell to any capable person who may acquire any type of goods that are published. The sole use of the Site confers to the general public the condition of user (hereinafter the "User" or the "Users") and implies the full and unconditional acceptance of each and every one of the general and particular conditions included in these Terms and Conditions at the very moment the User accesses the Site. The term "Customer" or "Customers" refers to Users who conclude a purchase on the Site. This instrument precisely describes the general terms and conditions applicable to the use of the services offered by Nivada Swiss consisting of the sale of products in general, including but not limited to wristwatches, to Users and Customers within the Site. The company will ask the customer to sign the Voucher and a copy of an official ID to conclude the online sale, this is for security purposes for both parties.
1. Use of the website and purchase
1.1. Use of the website and registration
To access the Site it is necessary to enter the address of the page www.nivadaswiss.com. The condition of User implies acceptance of the Terms and Conditions of Use of the Website in the version published at the time of accessing the Site.
If desired, it is also possible to register on the Site by means of a registration request and filling in the registration data on the Site itself. The User's registration on the Site is free of charge. Registration to the Site gives the User access to functionalities such as the possibility to create a list of favorite products, view his/her purchase history, or to expedite potential future purchases.
1.2. Payment Methods
Credit or Debit cards issued in the Mexican Republic.
The User can securely pay for his/her purchase with any Visa, MasterCard or American Express credit or debit card. It is important to mention that the final authorization of the purchase will depend on the Client's Bank.
Paypal
The User can make the payment with his PayPal account.
Cash payment in convenience stores
The main affiliated convenience stores are Walmart, Farmacias del Ahorro, 7 Eleven, Farmacias Benavides, Circulo K, Waldo's. Each store accepts a different maximum amount per payment, detailed in this page: https://www.paynet.com.mx/
Upon completion of your purchase on the Site, the Customer will receive a digital payment reference with which you can proceed to pay for your order within a maximum period of 3 calendar days, at any of the branches of the affiliated stores in Mexico.
In case of returns and paying in cash at a convenience store, the Customer must have a bank account in his/her name in order to proceed with the refund (see section "Refund").
Option to pay in months without interest in case of promotions.
This option is only available for credit card payments and, when made and published on the Site, will only be three months interest-free. To calculate the monthly amount of your payment under the Months Without Interest (MSI) program, we divide the total amount of your purchase into equal parts according to the duration of your plan. The Total Annual Percentage Rate (TAC) for the Interest-Free Months program is 0%. We do not charge interest on MSI purchases; however, fees may be charged depending on the agreement you have with your credit card issuing bank.
1.3. Availability of our products
All information and details regarding the availability, shipping or delivery of any of our products reflect only an estimate. In the event that, for any reason, during the processing of your order, the product ordered is no longer available, no charge will be made with respect to such product, and the corresponding order will be canceled.
1.4. Promotions and Discounts
Are those promotions or discounts on the price of the product that is established on the Site, which will be subject to the conditions, restrictions, term of duration, or volume of the products that will be found in the different announcements published on the website.
2. Conditions of shipment
2.1. Shipment of the product
Delivery is made through courier companies contracted by Nivada Swiss to carry out the national shipment of your purchase orders placed and concluded at www.nivadaswiss.com. All our shipments are standard. You can make your purchases online from anywhere in the world, but the delivery of the merchandise will be made only within the territory of the Mexican Republic (only and exclusively). At the moment it is not possible to send the merchandise outside the Mexican Republic, however, we hope in the future to be able to provide this service.
The delivery will be made to the address provided by the Customer, which must be made at the time of confirming the order, provided that it is located within the Mexican Republic.
2.2. Delivery of the product
At the time of receiving the product, at the address provided, the Customer is obliged to:
1. present an original valid official identification with the name of the Client or the final recipient,
2. open his package and inspect the product (the case must contain the watch, potential accessories, the sealed warranty and the instruction manual) in front of the parcel agent before signing the delivery receipt,
3. note the condition in which your package arrived on the delivery receipt, noting any potential faults (incomplete package, damaged watch, etc.); in this case, it should be noted that you must keep the product and not return it at that time to the courier, the return has another procedure (see "Return" section).
In case of any defect, the Customer may use the means indicated in the "Return" or "Warranty" section of these Terms and Conditions.
2.3. Delivery Times
Our purchase orders are processed in less than 72 working hours. The delivery of the merchandise will be made in a period of 3 to 5 business days on average once the purchase order has been processed and the payment has been confirmed. It is important to mention that, in order to comply with this, it is necessary that the recipient's address contains complete data.
The delivery is made through courier companies outside Nivada Swiss hired for this purpose by the latter. It is therefore possible that delivery times may vary for logistical reasons or due to unforeseen circumstances or force majeure. In the event that the product is not delivered on time, the Customer shall not be entitled to claim any default interest from Nivada Swiss.
At any time, the Customer may check the status of the shipment (on the parcel company's website) with the tracking number provided by e-mail after the purchase. You may also contact the Nivada Swiss Customer Service Center for the shipping status.
2.4. Delivery cost
The delivery of your product is free of charge on your purchase throughout the Mexican Republic.
3. Invoicing
To request your invoice, it will be necessary to send the following data to our e-mail atencion@nivadaswiss.com

Once invoiced you will not be able to make refunds. You have 30 calendar days to request your invoice after the day of your purchase.
4. Warranty
The Company imports Nivada Swiss watches and guarantees them against manufacturing and workmanship defects, as well as its parts and components for a period of 1 (one) year, from the moment of purchase.
To validate this warranty, you must send the product along with the policy duly stamped, the photocopy of proof of payment or email confirmation of purchase as appropriate (and in both cases must contain the order number), a photocopy of the current official identification of the Customer (person who made the purchase and if a photocopy of the current official identification of the final recipient) to the Customer Service Center listed at the end of this warranty, where you can repair and / or purchase spare parts, parts, consumables and accessories potentially necessary; who will be responsible for the transportation costs to make this warranty effective in the Mexican Republic.

Exceptions not covered by the warranty:
When it has not been operated in accordance with the enclosed instructions for use.
When it has been operated in other than normal conditions.
When it has been repaired by persons not authorized by Holzer y Compañía. S.A. de C.V.
In the event that the watch is not under warranty, you may request and pay for repairs, consumables and potential accessories as diagnosed by our Customer Service Center.

5. Returns and exchanges
5.1. Returns
The product can only be returned in the following cases and under the following conditions:
The watch must be in its original box with all packing materials, manual, sealed warranty and must include any other potential accessories that came with the watch.
No used watch, or watch showing damage from misuse, will be accepted.
No customized watch (engraving, or if links are added or reduced to the bracelet) will be accepted.
Case 1: Return because, when checking the package upon delivery by the courier, the package is incomplete or damaged and the watch is damaged or broken.
In this case, the Customer must:
note on the package delivery receipt the condition in which the package was received, whether it is broken or damaged, and the condition of the watch. It should be noted that you must keep the product and not return it to the courier.
Please contact the Customer Service Center atencion@nivadaswiss.com who will send you a free guide for the return of the product.
once the watch has been received by the Customer Service Center, it will undergo a review within 7 working days to ensure that all of the above elements are met in order for the watch to be returned and the money paid to be refunded (according to the terms detailed in the "Refund" section).
Case 2: Return due to manufacturing defect or malfunction found after having received the package correctly and within the term of the warranty
In this case, the Customer must:
contact the Customer Service Center atencion@nivadaswiss.com who will send him/her a free guide for the return of the product once the watch is received by the Customer Service Center, it will undergo a review within 7 working days to ensure that it complies with all the above elements so that if applicable the warranty service will be applied and the watch will be repaired, and it will be reshipped to him/her (according to the terms detailed in the Warranty section).
Case 2: Return by decision of the Customer.
In this case
the return shall be made in accordance with the LFPC law*.
the Customer will have to send the product to the Customer Service Center by the parcel of his choice and will be responsible for the cost of freight and insurance.
once the watch is received by the Customer Service Center, it will be reviewed within 7 working days to ensure that it complies with all the above mentioned elements in order to apply the return of the watch and therefore the refund of the money paid (according to the terms detailed in the "Refund" section). The return of any product purchased in the online store can only be done digitally. It is therefore impossible to return goods in physical stores except to the Nivada Swiss Customer Service Center.

The refund (return of the money paid) to the Customer will be made upon receipt and qualification of the watch at the Customer Service Center.
When the refund is applicable and if You paid by American Express credit card, debit card or in convenience stores, the operating expenses will be deducted. For more information on transaction fees, you should contact the Customer Service Center.
The respective reimbursement will be made through the same payment method that the Customer used to make the purchase (except for Customers who paid in cash at convenience stores, these Customers must provide the number of the bank account in their own name in order to be reimbursed). Depending on the method of payment and the bank, the time to see the refund reflected may vary.
5.3. Changes
No exchanges will be made. You will only have to make a return (according to the terms detailed in the "Return" section) and make a new purchase in the online store.
